5 Things to Do After a Car Wreck

By Tad Nelson – League City & Houston Personal Injury Lawyer

Getting into a car wreck is one of the most stressful, confusing moments a normal person can experience. One second you’re heading down I-45, FM 518, or Highway 146 thinking about dinner plans or the homework your kids need to finish. The next second, there’s the sound of crunching metal, broken glass everywhere, flashing lights, and a knot in your stomach that won’t go away. Most people don’t crash cars for a living. They don’t deal with police reports, insurance adjusters, and injury claims regularly. So when it happens, they are left wondering the same thing: “What in the world am I supposed to do now?”

Key Takeaways

• Car wrecks are overwhelmingly caused by preventable human error. Distracted driving is a leading cause of car wrecks, followed by speeding and impaired driving-accounting for roughly 90% of incidents on Texas roads. The consequences of car wrecks include physical injuries and emotional trauma that can last years.

• Five critical steps protect your health and your case. After any crash, you should take photos of everything, find witnesses, document the exact location, get prompt medical care, and talk to a car wreck lawyer before dealing with insurance adjusters. Avoid admitting fault or apologizing at the scene of the accident.

• Texas law gives you two years-but waiting is dangerous. Generally speaking, the statute of limitations for a personal injury lawsuit in Texas is two years from the crash date. But evidence disappears, memories fade, and insurance companies use delays against you.

• Insurance companies are not on your side. Their adjusters are trained to minimize payouts. Early settlement offers are almost always lower than the true value of your claim. Legal representation is crucial for navigating personal injury claims.

• Tad Nelson & Associates is a local law firm providing legal services across Galveston County and Greater Houston, offering free consultations and personalized representation after serious car wrecks, wrongful death, and cases where criminal and civil law overlap.

Car Wrecks in Houston & Galveston: Why They’re So Devastating

Picture a League City commuter in 2026 merging onto the Gulf Freeway after a long day downtown. Traffic slows, a driver behind glances at a text message, and in the span of two seconds everything changes. Personal injury claims often arise from car accidents exactly like this-sudden, violent, and completely preventable.

More than 90% of car wrecks are linked to human error. According to TxDOT crash data, failure to control speed, driver inattention, and failure to yield right of way remain the top contributing factors in crash fatalities and serious injuries statewide. Speeding increases crash severity and reduces reaction time. Distracted driving-especially texting-continues to rank as one of the most dangerous behaviors on Texas roads.

Victims find themselves drowning in police codes, claim numbers, and medical jargon while the insurance company and lawyers on the other side already know every rule of the game. Car wrecks are a major cause of traumatic brain injuries, spinal cord injuries, and wrongful death across Harris and Galveston Counties, particularly along high-volume corridors like I-45, the Galveston Causeway, and NASA Road 1.

Let’s slow everything down and walk through this step by step-plain English, no law school lectures.

Before the Crash: Common Causes of Car Wrecks in the Houston–Galveston Corridor

Understanding how wrecks happen on the Gulf Freeway and dense Houston surface streets does two things: it helps you drive safer, and it builds the foundation for proving negligence if you’re ever hurt by someone else’s carelessness.

The leading causes include:

• Distracted driving – checking texts, adjusting GPS, eating behind the wheel. Even a two-second glance away from the road at highway speed covers the length of a football field.

• Speeding and aggressive driving – reckless lane changes on I-45, tailgating on Highway 3, and blowing through yellow lights on FM 518.

• Drunk and drugged driving – driving under the influence impairs judgment and coordination. DWI/DUI cases involve driving under the influence of alcohol or drugs, and impaired drivers remain a relentless danger across Texas. Fatigued driving is as dangerous as driving under the influence, yet many commuters ignore it.

• Weather and road conditions – adverse weather conditions such as rain and snow can increase crash risk, and sudden Gulf thunderstorms make causeway surfaces and feeder roads dangerously slick.

These behaviors map directly to specific wreck types: rear-end collisions on feeder roads, side-impacts at intersections like NASA Road 1 and I-45, and high-speed rollovers on flyovers. The same facts later become the building blocks for proving negligence in a Texas personal injury lawsuit.

What Can Go Wrong: Types of Injuries After a Car Wreck

Even a “minor” fender bender in Friendswood or League City can hide serious injuries that surface days later. Check for injuries immediately after a car wreck-do not assume you are fine.

Common injuries include:

• Whiplash and neck strains from sudden deceleration

• Concussions and traumatic brain injuries

• Herniated discs and spinal cord injuries that can lead to permanent disability

• Broken bones, shoulder damage, and knee injuries from bracing against impact

• Facial fractures and lacerations from airbags and shattered glass

Catastrophic outcomes:

• Paralysis from high-speed collisions

• Severe burn injuries from vehicle fires

• Internal bleeding that operates like a silent threat, remaining invisible while inflicting fatal damage

Psychological harm is real and compensable. PTSD, anxiety about driving, and sleep disorders are not “in your head”-they are legitimate damages supported by medical evidence. High crash costs include medical bills, vehicle repairs, and legal fees that compound quickly when injuries are severe.

Prompt medical documentation of all injuries is critical to link them legally to the wreck and support a future settlement or lawsuit.

Step 1: Become a Photographer – Document the Scene Immediately

After checking for life-threatening emergencies and calling 911 (call 911 right away if anyone needs medical help), the most powerful thing you can do is use your phone camera to freeze the scene in time. Document the accident scene with clear photos-this is evidence that cannot be recreated later.

What to photograph:

• All vehicles from multiple angles (front, rear, sides)

• Close-ups of damage, deployed airbags, cracked windshields

• License plates of every vehicle involved

• Skid marks, debris, and road conditions

• Traffic lights, stop signs, lane markings, and construction zones

• Your own visible injuries

Timestamp your photos if possible and back them up to cloud storage immediately. Phones get lost, damaged, or stolen. These images often force insurance companies to accept liability faster or improve their settlement offers. In the legal world, we call it meeting your “burden of proof”-and photos lock in the truth before it fades.

Step 2: Look Around for Witnesses Before They Disappear

Right after a crash in Clear Lake, downtown Houston, or a Galveston tourist zone, neutral witnesses are quietly getting back into their cars and driving away. That is a massive missed opportunity.

Always exchange information with the other driver, but go further-approach anyone who stopped to help, nearby pedestrians, or drivers who pulled over and politely request names, cell numbers, and email addresses.

Independent witnesses are especially valuable when liability is contested. If both drivers claim they had the green light at FM 646 and I-45, a neutral bystander who saw the truth is pure gold. Police officers usually arrive after the collision; they rarely witness it. Surveillance cameras and 911 audio may exist, but having a live witness makes it far easier for attorneys to build leverage.

Tad Nelson & Associates can later follow up with these witnesses, obtain sworn statements, and prepare them for depositions or trial testimony.

Step 3: Pin Down the Exact Location and Jurisdiction

Saying your wreck happened “on I-45” isn’t enough. That highway runs for miles. Location controls which law enforcement agency responds, which court has jurisdiction, and what video evidence might exist.

Be specific. Examples of useful descriptions:

• “Southbound I-45 just before the NASA Road 1 exit”

• “Seawall Boulevard near 61st Street in Galveston”

• “FM 518 at the Highway 3 intersection in League City”

Snap photos of exit signs, mile markers, street signs, and nearby businesses. Move to a safe location out of traffic if possible, and turn on hazard lights to alert other drivers. This information helps your lawyer quickly pull crash reports, request body-cam footage, and send preservation letters for traffic or surveillance video before it is overwritten. Jurisdiction also affects where the eventual trial would take place-Galveston County courts operate under different local rules than Harris County courts.

Step 4: Get Immediate Medical Attention and Follow Through

This is where tough Texans tend to hurt their own cases. After a crash on the Gulf Freeway, adrenaline masks pain. People say “I’m fine” at the scene, then wake up the next morning unable to turn their heads.

Go to the ER, urgent care, or your regular doctor the same day if you experience any pain, dizziness, confusion, numbness, or visible injury. Medical records from Houston Methodist, UTMB Galveston, or local clinics create the paper trail that proves causation between the crash and your injuries.

Avoid “gaps in treatment”:

• Attend every follow-up appointment

• Complete prescribed physical therapy and imaging studies

• Document symptoms in your own words

Insurers use treatment delays and missed appointments to argue injuries were minor, unrelated, or caused by something else. Some injuries, such as fractures or internal injuries, may require surgery for proper recovery. Always attend all your medical appointments following a car wreck to ensure proper recovery and documentation. Your medical records become the backbone of any personal injury case.

Step 5: Talk to a Real Lawyer or Law Firms Before You Talk to the Insurance Company

Insurance adjusters are not your friends. They are trained professionals whose goal is to save their company money. Their job is to pay you as little as possible, as quickly as possible. Think of them as a goalie-their entire purpose is to block you from getting paid.

A good personal injury lawyer levels the playing field. Personal injury attorneys specialize in representing injured clients, and in the U.S., personal injury claims can involve negligence cases that require careful legal work to win.

Report the accident to your insurance company as soon as possible, but do not give a recorded statement to the at-fault driver’s insurer or sign any releases before consulting counsel. Early legal services can prevent mistakes-like admitting partial fault or downplaying injuries-that are nearly impossible to undo later in litigation.

Tad Nelson & Associates offers free initial consultations for car wreck victims in League City, Galveston, and Greater Houston. Lawyers often perform extensive research into relevant case facts, and getting that process started early makes a real difference.

Texas Car Wreck Law 101: Negligence, Fault, and Deadlines

Let’s break down the “fancy legal words” that control car wreck claims in Texas so you understand exactly what’s happening in your case. In some jurisdictions, only licensed lawyers can provide legal advice on these matters-and for good reason.

The Four Elements of Negligence

Every car wreck case is built on negligence-a legal word for carelessness. To win, we prove four things:

Element	What It Means	Example
Duty of Care	All drivers must follow the rules of the road	Obeying speed limits, watching for pedestrians
Breach	Someone broke that duty	Texting through a red light on FM 518
Causation	The breach caused the crash and injuries	The texting driver rear-ended you at 45 mph
Damages	You suffered real, measurable losses	Medical bills, lost wages, pain

Modified Comparative Negligence (The 51% Rule)

Texas uses a modified comparative negligence rule. If you are 51% or more at fault, you recover nothing. If you are less than 51% at fault, your damages are reduced by your percentage of responsibility.

For example: a jury values your case at $100,000, but finds you 20% at fault for speeding. You receive $80,000. This is why insurance companies aggressively try to pin blame on you-if they push you past 50%, they pay zero.

The Two-Year Deadline (Statute of Limitations)

Under Texas law, you generally have two years from the date of the crash to file a lawsuit. Miss it by one day and the court throws your case out, regardless of how strong your evidence is. Special caution applies to wrongful death claims and cases involving a government entity, where notice periods can be shorter.

Because these rules are unforgiving, it’s risky to “wait and see” instead of getting timely advice from qualified attorneys.

What You Can Recover: Damages After a Serious Car Wreck

“Damages” is the legal term for the categories of losses you can be compensated for. Victims can seek monetary damages in personal injury lawsuits, and those damages fall into two main buckets:

Economic Damages (the math you can prove):

• Past and future medical bills (ER, surgery, physical therapy, imaging)

• Lost wages from missed work

• Decreased earning capacity if injuries limit your career

• Property damage to the vehicle

• Towing, storage, and rental car expenses

Non-Economic Damages (the human cost):

• Pain and suffering from whiplash, fractures, and recovery

• Mental anguish, PTSD, and fear of driving

• Physical impairment-things you can no longer do, like playing with your kids or exercising

• Loss of enjoyment of life and disfigurement

In rare cases involving gross negligence-such as a drunk driver with a dangerously high BAC causing a fatal wreck-Texas law may allow punitive or exemplary damages designed to punish and deter egregious conduct.

An experienced lawyer analyzes medical records, employment history, and expert opinions to calculate a realistic settlement range before negotiating or filing a lawsuit.

Insurance Issues: Dealing With Uninsured, Underinsured, and Hit-and-Run Drivers Through Legal Services

Over 2.4 million Texas-registered vehicles-roughly 12% of all vehicles on the road-are not matched to an insurance policy. In a sprawling metro like Houston-Galveston, hit-and-run and uninsured driver crashes are a daily reality.

Key coverage types under Texas auto policies:

• Liability insurance – covers damage you cause to others

• PIP / MedPay – covers your own medical costs regardless of fault

• Uninsured/Underinsured Motorist (UM/UIM) – steps in when the at-fault driver has no insurance, not enough insurance, or flees the scene

Texas Insurance Code Chapter 1952 requires insurers to offer UM/UIM coverage, though policyholders can reject it in writing. If you don’t have it, get it-it’s usually affordable and can save you thousands.

Traps to watch for: strict notice requirements, insurers treating their own clients like adversaries, and pressure to give premature statements. A law firm can review your policies, negotiate with multiple carriers, and file suit when a company unreasonably delays or denies a valid claim.

From Claim to Lawsuit: How a Texas Car Wreck Case Actually Works

Most car wreck disputes settle without trial, but good settlement offers usually come only after preparation as if a lawsuit will be filed.

The typical sequence:

1. Claim and notice – report to insurers, preserve evidence

2. Investigation – gather photos, crash reports, witness statements, surveillance

3. Medical treatment phase – complete care, document everything

4. Demand letter – once treatment stabilizes, your attorney sends a detailed demand with supporting documents

5. Negotiation – adjusters respond; many civil cases settle here

6. Lawsuit – if no adequate offer, file a petition, serve defendants, enter discovery (written questions, depositions), attempt mediation, then proceed to trial if necessary

Strict rules of procedure and evidence apply in court, which is why most lawyers recommend hiring a firm that routinely handles personal injury litigation. The legal work involved in building and presenting a case is substantial, and courtroom experience matters.

Tad Nelson & Associates can handle both pre-suit negotiations and full litigation, including jury trials in Galveston County and surrounding Texas counties.

Staying Safe: Practical Prevention Tips for Texas Drivers

The best car wreck case is the one that never happens. Here are concrete safety measures tailored to Houston and Galveston driving:

• Always wear seatbelts. Safety practices like seat belts reduce the likelihood of serious injury or death during crashes. Make sure children are correctly restrained.

• Put the phone down. Eliminate texting, social media, and navigation adjustments while driving. Defensive driving includes anticipating other drivers’ mistakes and maintaining a safe following distance.

• Respect speed limits on I-45, coastal roads, and construction zones.

• Never drive impaired. Penalties for DWI/DUI can include fines up to $10,000. A DWI conviction can result in license suspension for up to 12 months. Repeat DWI offenders may face felony charges in many states, including Texas.

• Watch for seasonal risks – heavy beach traffic near Stewart Beach and East Beach, sudden Gulf thunderstorms, and increased impaired driving around holidays.

• Maintain your vehicle. Regular vehicle maintenance can prevent accidents caused by mechanical failures-check brakes, tires, and lights routinely.

While safe driving reduces risk, it cannot control other drivers’ negligence-another reason to know what to do and who to call if a wreck occurs.

When Car Wrecks Overlap With Other Legal Problems

Car wrecks sometimes intersect with other areas where Tad Nelson & Associates practices law, creating complex legal issues that demand coordinated strategy.

• DWI/DUI crossover – A wreck caused by an impaired driver can trigger both criminal charges and civil personal injury claims. Criminal defense lawyers specialize in defending those charged with crimes, and prosecutors in common law countries are usually licensed lawyers pursuing those charges aggressively. DWI/DUI cases often require legal representation for defense, and having one firm that can coordinate both DWI defense strategies and damage claims arising from the same incident is a significant advantage. Criminal defense involves preparing for court and trial advocacy on behalf of the accused.

• Family law complications – Family law includes divorce and child custody matters, and wreck-related injuries can affect custody arrangements, support obligations, and visitation schedules. Family law attorneys often represent clients in custody disputes, and custody arrangements can be modified based on changing circumstances like a parent’s injury. Family law cases can involve mediation to resolve disputes, and family law encompasses paternity and visitation rights issues that may need address after a serious wreck changes a family’s situation.

• Employment and licensing – A serious wreck can endanger a client’s commercial driver’s license or professional credentials, creating employment risk that extends far beyond the crash itself.

While Tad Nelson & Associates does not primarily focus on intellectual property or administrative agency matters, the firm’s broader litigation experience and ability to practice law across multiple areas helps clients navigate overlapping legal crises arising from a single wreck. Whether the issue involves a government entity, an act of gross negligence, or a complex multi-party lawsuit, having partners who understand every angle of your case matters.

Bonus Protection Tips: Recorded Statements, Journals, and Social Media

These “extra steps” can significantly strengthen a car wreck case-or, if ignored, quietly destroy it.

Never give a recorded statement without counsel. The other driver’s insurance company will call and make it sound routine. But early comments like “I’m fine” or “I didn’t see him coming” get twisted into evidence against you later. You are generally not required to give a recorded statement. Politely decline until you speak with a lawyer.

Keep a simple daily journal. Human memory is unreliable. Two years from now in a deposition, a clerk or judge may ask how you felt three weeks after the crash. A journal entry like “Tuesday the 14th-neck pain so bad I missed my daughter’s soccer game” is far more powerful than “it hurt.” Write down pain levels, medications, missed events, and limitations.

Go on a social media blackout. Defense lawyers and adjusters routinely monitor Facebook, Instagram, and TikTok. A smiling photo at a birthday party-even if you were in agony-gets shown to the general public on a jury as “proof” you’re fine. Do not post about the wreck, your injuries, or physical activities while a claim is pending.

Tad Nelson & Associates can provide further, case-specific counsel on communication and documents so you don’t accidentally undermine your own claim.

Frequently Asked Questions About Car Wrecks in Texas

These FAQs address common Texas-specific concerns not fully covered above. For questions about your particular situation in Houston, Galveston, or League City, contact Tad Nelson & Associates directly.

How much does it cost to hire Tad Nelson & Associates for a car wreck case?

Personal injury cases from car wrecks are typically handled on a contingency fee basis. This means the client pays no upfront legal fees. The firm receives a percentage of any settlement or verdict, plus reimbursement of case expenses, only if the case is successful. Initial consultations are free, and the specific fee arrangement is discussed and put in writing before representation begins. This structure ensures that anyone-regardless of their financial situation-can access qualified legal services after a serious wreck. Most lawyers who handle personal injury work this way, which levels the playing field against well-funded insurance companies.

What if I was partially at fault for the car wreck?

Under Texas’s modified comparative negligence system, a driver who is less than 51% at fault can still recover damages, but any award is reduced by their percentage of responsibility. Fault is often disputed and complex. A driver who was speeding five miles over the limit when another driver ran a red light might share a small number of percentage points of blame-but that doesn’t eliminate their case. Injured people should not assume they have no case just because they think they made a mistake. A lawyer can analyze how fault is likely to be assigned based on evidence and research into the specific facts.

Do I really need a lawyer if the insurance company already offered me a settlement?

Early settlement offers are almost always made before the full extent of injuries and future medical needs are known. These offers are typically lower than the true value of a claim. Before signing any release, have a law firm review it-because signing usually means you can never pursue additional money later, even if new problems arise. An education in how insurance companies operate reveals that their first offer is rarely their best one. This is the main article of advice that most people wish they had received before settling too early.

How long will my Texas car wreck case take to resolve?

Timing depends on injury severity, length of medical treatment, liability disputes, and court schedules. Straightforward cases might settle in a few months, while heavily contested or catastrophic injury cases involving extensive litigation can take a year or more. Rushing to settle before treatment stabilizes can leave victims without enough money for future care. A professor of trial advocacy once noted that patience in case preparation almost always yields better results for clients than speed. Your lawyer should focus on building the strongest possible case, not just closing the file quickly.

Can Tad Nelson & Associates help if the at-fault driver was arrested for DWI?

Yes. The firm handles both criminal defense for DWI charges and related personal injury or wrongful death civil cases, which involve separate but overlapping court proceedings. Having one law firm coordinating strategy helps manage evidence, protect constitutional rights, and advocate effectively whether you are the victim pursuing damages or the accused facing charges from the same incident. The bar examination that Tad Nelson passed decades ago was just the beginning-over 35 years of private practice and more than 400 jury trials represent the kind of experience that makes a difference when cases cross the line between criminal and civil law, and when judges and society alike demand accountability on the road.
