Innocent of a Sex Crime? What You’re Up Against

Fighting False Sex Crime Allegations

When someone walks into my office accused of a sex crime—especially something involving a child—and they tell me they’re innocent, I know exactly what we’re stepping into.

Experience Matters, A Lot

I’ve been practicing criminal law in Houston and Galveston since 1991. I’m Board Certified® in Criminal Law by the Texas Board of Legal Specialization™. I’ve handled cases that would keep most lawyers up at night. And I can tell you—nothing hits harder than representing someone falsely accused of molestation or sexual assault of a child.

These cases are brutal. The stress is off the charts. Not because I doubt my client, but because the accusation alone can destroy a life. Even if we win—fast acquittal, media coverage, full exoneration—the stigma sticks. You don’t bounce back from that. That’s why we take these cases seriously from day one.

Jury Selection During Sex Crime Trials

I always start jury selection the same way. I tell them I’ve got a young daughter. If someone ever laid hands on her, I don’t know what I’d do. And every juror nods. They get it. No one argues that touching a child is one of the worst crimes imaginable.

But then I ask them something else. I ask them to imagine being accused of it—and not having done a damn thing wrong. That silence? That’s when they realize what kind of case we’re about to try.

Here’s the truth: defending someone who didn’t do it means proving something didn’t happen. That’s no small task. We don’t just punch holes in the State’s story—we reconstruct the entire timeline. We show what actually happened during the alleged incident. We put witnesses in the room. We account for everyone who was there.

I did this recently in a case involving an apartment over a weekend. The allegation had a tight timeframe. So we subpoenaed everyone who was present from Friday morning to Sunday. And one by one, they testified. They described exactly what they saw, where they were, who was in which room. When we were done, the story the child told couldn’t possibly have happened. There were too many people around. Too many eyes. Too much truth in the way.

Sometimes these cases involve mistaken identity. With today’s forensic tools—especially DNA—it’s not as common as it used to be, but it still happens. If I think the wrong person’s being targeted, we treat that with the same level of intensity.

Bottom line—if you’re innocent, it doesn’t mean you’re safe. It means we’ve got to get to work immediately. We’ll document everything: text messages, witness lists, prior interactions, timelines, floorplans—whatever it takes. We’ll challenge every statement. Every inconsistency. Every assumption.
