In Texas a felony refers to a crime that is normally punishable by at least one year in jail. The most serious felonies can lead to life in prison–and even death in some murder cases. But any type of felony conviction will have life-altering consequences, including the loss of certain civil rights such as the ability to drive or own a firearm. ### How Texas Classified Felonies

Not all felonies are the same. Texas has five felony classifications: Capital, First Degree, Second Degree, Third Degree, and State Jail. In many serious felony cases the classification depends on the specific facts or circumstances. For example, if prosecutors allege a firearm or other deadly weapon was used, the felony classification might increase. In addition, a defendant may be charged with a higher classification if he or she has a prior criminal record.

At the lowest end of the scale–a state jail felony–a conviction is punishable by a prison sentence of between 180 days and 2 years plus a fine that cannot exceed $10,000. At the other end of the spectrum–excluding capital offenses where the death penalty may apply–a first-degree felony carries a mandatory sentence of between 5 and 99 years. Keep in mind, a first-degree felony does not just refer to murder or crimes resulting in the victim’s death–[sexual assault of a child](https://tadlaw.com/houston-tx/sex-crime-lawyer/sexual-offenses-against-children/) is a first-degree felony.
