Rules for drivers with a CDL are set by the Federal Motor Carrier Safety Administration (FMCSA). Commercial drivers are subject to random drug and alcohol testing performed by police or their employers and are considered to be driving while intoxicated when their blood alcohol concentration, or BAC level, is .04 or greater.
